1. Terms of Service

1.1. Main info

1.1.1. These Terms of Service define the basic concepts, mutual rights, and obligations according to which clients will be able to use the website Odds96.com (hereinafter “Odds96.com”, or the “Website”) and related gambling services offered on the Website (hereinafter collectively referred to as the “Services”).

1.1.2. The terms “you”, “your”, “customer”, “client”, “user” and “player” refer to any individual who accesses or uses the Website and its services, as well as any registered user of the Website.

1.1.14. In case of discrepancies between the English version of these rules and the version in any other language, the English version shall prevail.

1.2. Governing law

1.2.1. These Terms of Service comply with and are interpreted in accordance with the laws of Curaçao, and you are unconditionally subject to the exclusive (sole) law of the courts of the jurisdiction of Curaçao for settlement of any disputes (including claims for damages and counterclaims) that may arise in connection with the creation, legality, effect, interpretation or action, or legal relations, established by the Terms of Service or by any means arising from the Terms of Service.

1.3. Binding declarations

By using the Services, you agree to the provisions below:

1.3.1. You have already reached the age of majority required by applicable law and you can enter into legally binding agreements with us.

1.3.2. We do not guarantee the legality of providing online betting services and online casino-style games in any jurisdiction.

1.3.3. It is your responsibility to make sure that you live in a country where it is legal to place bets and play casino games using the Services (if in doubt, consult a local lawyer on this issue).

1.3.10. You may open only one account.

1.3.11. If we find that a Сlient is using more than one account, all these accounts will be terminated. This includes the use of accounts by representatives, relatives, colleagues, partners, those close to them or with vested interests, and/or third parties acting on your behalf.

1.3.12. You are solely responsible for reporting and accounting for any taxes applicable to you under applicable laws for any winnings that you receive while using our services.

1.3.13. You agree that you use the Services solely at your own discretion and at your own risk.

For the purposes of this clause:

(a) a PEP includes an individual holding the following offices or positions in or on behalf of any state:

(i) head of state or head of government,
(ii) member of the executive council of government or member of a legislature,
(iii) deputy minister or equivalent rank ambassador, attaché or counsellor of an ambassador,
(iv) military officer with a rank of general or above,
(v) president of a state-owned company or a state-owned bank,
(vi) head of a government agency,
(vii) judge of a supreme court, constitutional court, or other court of last resort, and
(viii) leader or president of a political party represented in a legislature;

(b) a HIO is a person who is, or was within the past five years, the primary person responsible for leading an international organisation or institution, and the international organisation or institution that they are, or were, the head of is either:

(i) an international organisation established by the government of any state; or
(ii) an institution established by an international organisation established by the government of any state;

(i) their spouse or common-law partner, or ex-spouse or former common-law partner,
(ii) their biological or adoptive child(ren),
(iii) their mother(s) or father(s),
(iv) the mother(s) or father(s) of their spouse or common-law partner (mother-in-law or father-in-law),
(v) their siblings;

(d) a close associate of a PEP or HIO includes persons who:

(i) are business partners of, or who beneficially own or control a business with a PEP or HIO,
(ii) are in a romantic relationship with a PEP or HIO;
(iii) are involved in financial transactions with a PEP or HIO,
(iv) serve as a member of the same board as a PEP or HIO,
(v) carry out charitable works closely with a PEP or HIO,
(vi) are jointly listed on a policy of insurance where one of the holders may be a PEP or HIO.

1.4. No warranties. Limitation of Liability

1.4.1. Your use of the Services is at your own risk. The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we, our officers, directors, employees, shareholders, parents, subsidiaries, affiliates, licensors, and agents hereby expressly disclaim any and all representations and warranties of every kind, whether express or implied, regarding the Services, its content, and any information or other materials provided by us in connection with use of the Services, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement and those warranties arising by law, statute, usage of trade, or course of dealing.

1.4.6. We shall be not liable for information technology problems caused by the operation of equipment used by you or other players to access the Website or for malfunctions in the operation of your Internet-provider or Internet-provider of other players.

1.4.7. We, including our employees or agents, partners or suppliers shall not be liable for any damage, including loss of winnings, due to error on your part or on the part of our Website.

1.4.8. You accept and acknowledge that, in case of a malfunction in the Website or its interoperability, any bets made during such malfunctioning shall be considered void. Funds obtained from a malfunctioning game shall be considered void, as well as any subsequent game rounds with said funds.

1.4.9. We reserve the right to declare a wager void, partially or in full, if there was a misprint, or a mistake, or a technical error regarding odds or software operation.

1.4.10. In the event of any dispute, you agree that the server logs and records shall act as the final authority in determining the outcome of any claim.

1.4.11. You agree that in the unlikely event of a disagreement between the result that appears on your screen and the game server, the result that was logged on the game server will prevail, and you acknowledge and agree that our records will be the final authority in determining the terms and circumstances of your participation in the relevant online gaming activity and the results of this participation.

1.4.15. We assume no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, or use of, the services.

1.4.16. We reserve the right to change or modify the content of the Website and the Services at any time without prior notification and will not be liable for possible consequences of such changes. We may suspend, discontinue or restrict access to any portion of the Website and/or Services at any time and without notice.

1.4.17. If the Company mistakenly credit your Player account with a bonus or winnings that do not belong to you, whether due to a technical issue, error in the paytables, human error or otherwise, the amount and/or the winnings from such bonus will remain the Company property and will be deducted from your Player account.

1.4.18. If you have withdrawn funds that do not belong to you prior to us becoming aware of the error, the mistakenly paid amount will (without prejudice to other remedies and actions that may be available at law) constitute a debt owed by you to us.

1.6. Prohibited uses. Account suspension and termination

1.6.1. We may, at our absolute discretion and at any time, restrict your access to the Services and/or temporarily suspend, or permanently terminate, your account without cause and for any reason, including but not limited to if:

(a) we suspect that you are engaging in illegal or fraudulent activity, including but not limited to:

a Client provides false, fake, inaccurate, misleading and/or incomplete information about his/her identity and/or fake or stolen identification documents;
a Client used dishonest means of obtaining information or circumventing restrictions set by Odds96;
a Client used someone else's payment method for deposit and/or withdrawal.

(b) we are required to do so by any applicable law, rule, or regulations, including but not limited to:

a Client uses our Website from a restricted jurisdiction;
a Client holds citizenship of a restricted jurisdiction;
a Client fails to prove that he/she is at the legal age (at least 18 years old);
a Client is a Politically Exposed Person as defined above.

(c) you do not, within a reasonable time of our requesting it, provide us with information that may be required for us to provide the Services to you, or provided information was fake or misleading.
(d) we suspect that you are acting in a manner which may create a legal liability for you, us, or third parties, or which may be detrimental to the conduct of our business generally, including but not limited to:

a Client had the information about the result of an event at the time of placing his/her bet;
a Client had an opportunity to affect the outcome of an event being a direct participant (athletes, referees, coaches, etc.);
a Client has multiple accounts registered on our Website (multiple registrations, multi-accounting);
bets were placed by a group of Clients acting in concert (syndicate) in order to exceed the limits set by Odds96.

(e) we deem that you are taking unfair advantage of us or of any other player, or that you are otherwise acting unfairly, including but not limited to:

bets were placed by a group of Clients acting in concert (syndicate) in order to exceed the limits set by Odds96;
a Client is suspected of using special software or technical means allowing automation of sports betting.

(f) we have reason to believe that a Client's account is being used for transactions unrelated to gaming activities, such as money laundering or fund cycling. This may include, but is not limited to, the following situations:

attempts to deposit funds and then withdraw them without engaging in genuine gaming activities or by placing wagers with minimal odds;
using the account primarily for financial transactions not associated with active participation in games on the platform.

(g) you are prohibited from interacting with the services due to any term of a contract of employment, or restriction of any professional body which applies to you, including but not limited to:

a Client is a Politically Exposed Person as defined above.

(h) we suspect that you have (or may have) otherwise materially breached these Terms of Service, including but not limited to:

a Client violates other rules and obligations set forth in these Terms of Service, as well as in other Legal documents listed above;
a Client shared his password or other account credentials with third parties to access his account on our Website.

1.6.2. You undertake to indemnify any damages, costs or expenses arising from or in connection with any prohibited activity. You undertake to notify us of any prohibited activities by any person, to provide the necessary assistance to us and all information regarding this matter which you possess.

1.6.3. If the Client’s account is terminated, this termination will affect all accounts associated with the Client except for one account which will be retained at the discretion of our compliance.

1.6.4. Any funds deposited to an account by persons who are located in a Restricted Territory, whether permanently or temporarily, will be considered forfeit and will not be returned.

1.6.5. Should we have reason to believe that you are younger than any applicable Age of Majority, or were younger than any applicable Age of Majority when you interacted with the Services in a manner which would have required you to be at least the Age of Majority ("Underage"):

(a) we will immediately restrict your ability to interact with the Services and request any withdrawals from, or make deposits to, your account; and
(b) we will return any funds deposited into your account while Underage, less any winnings paid on said funds; and we reserve the right to seek recovery of any winnings paid to you while Underage to the extent that they exceed the aggregate total of funds deposited while Underage.

1.6.6. A charge fee could be applied if the anti-fraud department has confirmation that the game account was used in violation of the Terms of Service. The charge fee will depend on the severity of the violation and will be categorized as follows:

1.9.2. We are not responsible for any loss or damage incurred in connection therewith. In this case, we reserve the right to cancel or suspend the Services without any liability.

1.10. Dispute resolution

1.10.1. Players may submit a formal complaint within 6 months of the incident via our Complaint Submission Form, available online or in downloadable format.

1.10.2. We acknowledge complaints within:

2 business days for Responsible Gaming issues.
7 calendar days for other issues.

1.10.3. Complaints will be resolved:

Within 5 business days (Responsible Gaming).
Within 4 weeks (general complaints), extendable once by an additional 4 weeks.

1.10.4. If unsatisfied, players may escalate to an independent ADR provider certified by the relevant Kenyan authority at no cost. Once ADR is completed, it cannot be reopened.

1.10.5. The relevant authority does not resolve disputes but can be contacted for regulatory concerns.
